General Terms and Conditions for Paid Subscription to THE LEMON WAY
FIRST.-
These General Terms and Conditions govern the contractual relationship between Jimena Ruiz Entrecanales (hereinafter, "The Lemon Way"), with National ID No. 51103371Q and registered address at Calle Padre Arrupe 15, 28050 Madrid. Email: jimena@thelemonway.com, and the individual user who, meeting the requirements established in these Terms and Conditions, contracts a subscription on the website www.thelemonway.com.
These Terms and Conditions are binding on both parties.
The subscription service consists of the possibility to read all articles and content available on the website. Access is limited to one user account per subscription and intended for individual use. Simultaneous logins from multiple users are not permitted.
In these General Terms and Conditions, the following terms shall have the meaning ascribed to them below:
"Subscriber": Refers to the individual who, meeting the requirements established in these Terms and Conditions, contracts the paid subscription to the Service on the website www.thelemonway.com and, therefore, accepts these General Terms and Conditions.
"Service": Refers to the paid subscription service offered by The Lemon Way through its website, which provides access to all articles and exclusive content of the website portal, according to the contracted subscription plan.
Products requiring an additional payment shall not form part of the service, such as cooking courses, and as expressly indicated in such products.
SECOND.-
The service is contracted under the following conditions according to the following subscription plans:
Your subscription to The Lemon Way provides you with [monthly/annual] access to [all exclusive content including recipes, articles, expert articles, and a curated resource library available within your chosen tier, as well as new content added during your active subscription period]. Upon successful payment, your access begins immediately and continues for the full duration of your active subscription period.
Upon expiration of any contract period selected by the subscriber, the subscription to the service will automatically renew for periods of equal duration, unless the subscriber communicates their intention not to renew it, at any time, during the validity of the then-current subscription, in accordance with our Cancellation Policy. Access is granted solely for your personal, non-commercial use and is non-transferable.
THIRD.-
The service requires a stable internet connection and access via a standard and updated system. We recommend using the latest versions of Chrome, Safari, Firefox, or Edge for optimal performance.
The user may contract for the service electronically on the website, requiring prior registration and acceptance of these Conditions and The Lemon Way's Privacy Policy. Access to the content requires account registration and login through our Member Area powered by Squarespace.
If the subscriber chooses to subscribe and pay for the service through an external platform via the corresponding option, they must also comply with the terms and conditions of said platform, for which we expressly disclaim all liability.
Upon completion of the contracting process, the subscriber will receive a confirmation of the subscription via the email account they provided. The subscription shall be deemed perfected and, consequently, the service will be activated only upon the subscriber's effective payment. The Lemon Way is not obligated to archive the electronic document formalizing the contract through acceptance and payment, nor to make said contract accessible to the subscriber. Therefore, the Subscriber is advised to store or print the contract.
FOURTH.-
Only individuals aged 18 or older may contract for the service.
FIFTH.- Subscription Fees and Payment
5.1. Subscription Fees: The Subscriber agrees to pay the subscription fees ("Fees") corresponding to the selected subscription plan, as displayed on the website's designated pricing page [https://www.thelemonway.com/the-lemon-membership] at the time of purchase. The Fees are payable in [Euros (€)] and are presented exclusive of any applicable Value Added Tax (VAT), duties, or other levies. All such applicable taxes, duties, or levies shall be added to the total amount payable at checkout.
Monthly Subscription: €6.00 per month, exclusive of VAT.
Annual Subscription: €59.04 per year, exclusive of VAT.
5.2. Billing Cycle: Fees are billed in advance on a [monthly/annual] basis, depending on the subscription plan chosen by the Subscriber. The billing cycle commences on the date of successful payment and continues for the duration of the chosen subscription term.
5.3. Automatic Renewal: ALL SUBSCRIPTIONS WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING CYCLE (MONTHLY/ANNUALLY) FOR SUCCESSIVE PERIODS OF THE SAME DURATION, unless the Subscriber cancels their subscription prior to the renewal date. By maintaining an active subscription, the Subscriber explicitly authorizes The Lemon Way (or its third-party payment processor) to charge the then-current Fees for each subsequent renewal period to the payment method on file.
5.4. Payment Authorization: By providing payment information and confirming a subscription, the Subscriber authorizes The Lemon Way to process the payment for the initial subscription term and any subsequent renewal terms via the chosen payment method. The Subscriber represents and warrants that they are an authorized user of the payment method provided.
5.5. Payment Processing: The Lemon Way utilizes third-party payment processors to manage all transactions. By subscribing, the Subscriber acknowledges and agrees that all payment processing is subject to the terms, conditions, and privacy policies of these third-party payment processors ["such as Stripe's terms found at [https://stripe.com/en-es/legal/ssa#general-terms]"]. The Lemon Way is not responsible for any issues arising from the processing of payments by these third parties, including but not limited to, unauthorized transactions, delays, or failures in payment processing, beyond its direct control. The Lemon Way uses Squarespace’s Member Area platform to manage subscriptions, and Stripe as its primary payment processor
5.6. Changes to Fees: The Lemon Way reserves the right to modify its subscription Fees at any time. Any changes to the Fees will be communicated to existing Subscribers at least [thirty (30)] days prior to their next renewal date. Such changes will take effect at the start of the next billing cycle following the notice period. If the Subscriber does not agree with the Fee changes, they must cancel their subscription before the new Fees come into effect.
5.7. Non-Refundable Fees: All Fees paid are generally non-refundable, except as explicitly stated in our Cancellation Policy or as required by applicable law.
SIXTH.-
In accordance with Article 103, letter m) of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, in the case of distance contracts, once the service has commenced and given that it involves access to digital content not provided on a tangible medium to the user, the subscriber may not exercise the right of withdrawal.
The subscriber shall be solely responsible for the use of the service, which must, in all cases, be carried out in accordance with the Conditions established herein as well as the rules set forth at the following link: https://www.thelemonway.com/privacy
The subscriber acknowledges and accepts that all content accessible through the service is for personal use and may not use the service for commercial or public purposes, nor share it with third parties, nor make illegal use of the service. The subscriber agrees not to share their Member Area login credentials with any other individual. Accounts suspected of misuse may be suspended or terminated.
The Lemon Way shall not be liable for the subscriber's failure to use the service, their non-compliance with the conditions and rules of use, or for access to the service being limited due to malfunction or overload of the Internet or other networks, telecommunications services, failures or problems related to computers or other devices or communication systems.
Any use of the service that contravenes the provisions of this clause and the conditions shall be considered a material breach by the subscriber of this contract, with the effects established in the breach clause.
SEVENTH.-
The subscriber may unilaterally cancel the contracted subscription and, consequently, unsubscribe from the service at any time during its validity. Such cancellation or unsubscription shall under no circumstances entail the reimbursement of the amounts paid by the subscriber as consideration for the subscription. Such amounts are non-refundable.
To cancel, log in to your account and follow the cancellation steps under your Member Area profile. Cancellations take effect at the end of your current billing cycle. You will receive an email confirming your cancellation. Please retain this for your records.
Refund Policy
Fees are non-refundable except in the event of a documented technical failure on our part, or as required by law.
EIGHTH.-
Ms. Jimena Ruiz Entrecanales is the owner of all intellectual and industrial property rights pertaining to her website portal, as well as the elements contained therein (including, but not limited to, images, sound, audio, video, software or texts; trademarks or logos, color combinations, structure and design, selection of materials used, and computer programs necessary for its operation, access, and use, etc.), and reserves all rights. Therefore, by virtue of the provisions of the Intellectual Property Law, the reproduction, distribution, transformation, and public communication, including the modality of making available, of all or part of the contents of the service on any medium and by any technical means, are expressly prohibited, without authorization.
NINTH.-
Without prejudice to any other grounds for termination established in these conditions, The Lemon Way shall have the right to terminate the contract with immediate effect and, simultaneously, make the service immediately unavailable to the subscriber for:
1. Non-payment of the subscription.
2. Unauthorized or illegal use by the subscriber.
3. Contractual breach by the subscriber.
The Lemon Way reserves the right to unilaterally modify these conditions at any time. However, such changes shall be notified to subscribers at least thirty (30) days in advance.

These conditions shall be interpreted and governed by Spanish law. The parties submit to the Courts of Madrid for the resolution of disputes.
